Agreement to Terms

By accessing and using the website at execprorc.com ("Site"), contacting ExecPro Restoration & Cleaning for an estimate or consultation, or engaging ExecPro for any services, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully before using this Site or our services.

If you do not agree to these Terms, please do not use this Site or engage our services.

These Terms apply to all visitors to the Site and all clients who engage ExecPro Restoration & Cleaning ("ExecPro," "we," "our," or "us") for mold remediation, water damage restoration, air quality testing, cleaning, general contracting, build-back services, or any other service we provide.

1. Services

ExecPro provides residential and commercial mold remediation, water damage restoration, air quality testing, cleaning, and general contracting services across Central and South New Jersey. The specific services to be performed for any client, along with the scope, timeline, and pricing, will be set forth in a separate written service agreement, estimate, or work order agreed upon by both parties ("Service Agreement").

These Terms apply to your use of this Site and, where not otherwise specified, to the general relationship between you and ExecPro. They do not supersede or replace any terms contained in a specific Service Agreement, though they operate alongside those terms unless expressly noted otherwise.

Service availability is subject to geographic coverage, scheduling, and capacity. ExecPro currently serves more than 100 communities across Central and South New Jersey. Availability in specific locations may change without prior notice.

2. Website Use

Permitted Use. You may use this Site for lawful purposes related to learning about ExecPro's services, contacting us, and accessing informational content. You may not use this Site in any way that:

  • Violates any applicable federal, state, or local law or regulation
  • Infringes on the intellectual property rights of ExecPro or any third party
  • Transmits harmful, offensive, or disruptive content
  • Attempts to gain unauthorized access to any portion of the Site, our systems, or the data of any other user
  • Interferes with the normal operation of the Site

Accuracy of Information. We make reasonable efforts to keep the content on this Site current and accurate. However, we do not warrant that all content is complete, error-free, or up to date. Service descriptions, service area coverage, pricing references, and other details may change. Always confirm current information directly with us before making decisions based on Site content.

Geographic Scope. This Site is intended for users located in the United States, specifically in New Jersey and surrounding states within our service area. We do not target or intend to serve users located in the European Union, the United Kingdom, Canada, or other countries outside the United States.

3. Contact Forms, Communications, and Consent to Outreach

Form Submissions. When you submit a contact form, request-a-quote form, or any other web form on this Site, you are initiating a business inquiry with ExecPro and consenting to receive a response from us by phone, email, or text message.

Consent to Communications. By providing your phone number through any form on this Site, you consent to receive calls and SMS text messages from ExecPro related to your inquiry and our services. You may opt out of text messages at any time by replying STOP.

Use of Contact Information in Advertising. When you submit a form on our website, a conversion event may be sent to one or more advertising platforms, including Google Ads, Microsoft Advertising, and Meta Platforms, for the purpose of measuring the effectiveness of our ad campaigns. In some cases, this may involve transmitting a hashed or anonymized version of your email address or phone number solely for attribution purposes. We do not sell this data to these platforms, and they are contractually restricted from using it for purposes beyond ad measurement on our behalf.

Cold Outreach. ExecPro may contact property owners, facility managers, real estate professionals, and other potential clients by email or phone to introduce our services. We acquire contact information for cold outreach only from legitimate business sources. Every cold outreach email identifies us clearly and provides a simple way to opt out. Every cold outreach phone call respects applicable do-not-call regulations. To opt out of all future outreach, email hello@execprorc.com with "Opt Out" in the subject line or call (888) 300-3772.

4. Estimates and Quotes

Estimates and quotes provided by ExecPro, whether through the Site, by phone, by email, or in person, represent our good-faith assessment of the work required based on visible and accessible conditions at the time of assessment. Estimates are not binding contracts.

Final costs may differ from initial estimates when:

  • Concealed damage, hidden mold growth, or structural conditions are discovered during the work
  • The client requests changes to the scope of work
  • Material costs change due to supply availability or market fluctuations
  • Access to affected areas was not available during the initial assessment

Any significant change in estimated cost will be communicated to the client before additional work proceeds, to the extent reasonably practicable.

5. Scheduling, Access, and Client Responsibilities

Access to Property. To perform services effectively, ExecPro requires reasonable and safe access to the affected areas of your property. You or an authorized representative must be available to grant access at the scheduled time or make prior arrangements for access.

Accurate Information. You agree to provide accurate information about your property, the nature of the damage or condition, any known hazards, and any insurance claims in progress. Providing inaccurate or incomplete information may affect the quality of our assessment and the accuracy of our estimate.

Preparation. Where preparation is required prior to service, such as clearing personal belongings from an affected area, ExecPro will communicate those requirements in advance. Delays caused by failure to prepare may result in rescheduling or additional charges.

Pets and Occupants. For health and safety reasons, we may request that occupants, children, and pets vacate certain areas of the property during remediation or restoration work. ExecPro will communicate these requirements as part of the service process.

6. Payment Terms

Payment terms for specific services will be outlined in the applicable Service Agreement. General payment terms are as follows:

  • A deposit may be required before work begins on larger or multi-phase projects.
  • Final payment is due upon completion of the agreed scope of work unless other terms are specified in writing.
  • Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month or the maximum rate permitted by New Jersey law, whichever is less.
  • In the event of a collection action related to unpaid invoices, ExecPro reserves the right to recover reasonable collection costs and attorney fees to the extent permitted by applicable law.

Payment does not constitute a waiver of any warranty or right ExecPro may have to return to address issues arising from the completed work.

7. Insurance Claims

ExecPro works with many clients who are filing insurance claims related to mold damage, water damage, or storm damage. When applicable:

  • ExecPro will cooperate with your insurance carrier and provide documentation reasonably required to support your claim.
  • ExecPro does not guarantee that any specific service will be covered by your insurance policy. Coverage determinations are made solely by the insurer.
  • You remain responsible for payment of any portion of the invoice not covered by insurance, including deductibles, exclusions, or coverage limitations.
  • Signing an Assignment of Benefits (AOB) or similar document, if applicable, may affect your rights and responsibilities. We encourage you to review any such document with your insurance agent or attorney before signing.

8. Warranties and Limitations

Workmanship Warranty. ExecPro warrants that services will be performed in a professional and workmanlike manner consistent with industry standards for mold remediation and property restoration. Any specific warranty terms applicable to a project will be stated in the Service Agreement.

No Guarantee Against Recurrence. ExecPro cannot guarantee that mold or water damage will not recur after remediation if the underlying moisture source is not permanently corrected, if new water intrusion events occur, or if conditions favorable to mold growth are reintroduced to the property. Our remediation addresses conditions present at the time of service within the agreed scope of work.

Air Quality Testing. Post-remediation clearance reports reflect air quality conditions at the time and location of testing. They do not certify conditions throughout the entire property or guarantee future air quality.

No Warranty on Third-Party Products. ExecPro passes through any manufacturer warranties on materials, products, or equipment used in your project but makes no independent warranty on third-party products beyond the workmanship standard above.

Limitation of Liability. To the fullest extent permitted by New Jersey law, ExecPro's total liability to any client for claims arising from services provided shall not exceed the total amount paid by the client for the specific service giving rise to the claim. ExecPro shall not be liable for indirect, incidental, consequential, or punitive damages arising from or related to services provided or not provided, regardless of whether ExecPro was advised of the possibility of such damages.

Nothing in these Terms limits ExecPro's liability for personal injury caused by gross negligence or willful misconduct, or for any other liability that cannot be limited under applicable law.

9. Cancellation and Rescheduling

If you need to cancel or reschedule a scheduled service appointment:

  • Please notify us at least 24 hours in advance by calling (888) 300-3772 or emailing hello@execprorc.com.
  • Cancellations made with less than 24 hours' notice for non-emergency services may be subject to a cancellation fee as specified in the Service Agreement.
  • Emergency services may have different cancellation terms given the nature of the deployment.

If ExecPro needs to reschedule due to weather, equipment issues, or staffing circumstances, we will notify you as promptly as possible and work to reschedule at the earliest available time.

10. Intellectual Property

All content on this Site, including text, images, graphics, logos, service descriptions, and other materials, is the property of ExecPro Restoration & Cleaning or its content licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, transmit, or use any content from this Site for commercial purposes without the prior written permission of ExecPro. Personal, non-commercial use for informational purposes is permitted provided that you do not remove or alter any copyright or proprietary notices.

The ExecPro name, logo, and related marks are the property of ExecPro Restoration & Cleaning. Nothing in these Terms grants any license or right to use our trademarks without our express written consent.

11. User-Submitted Content

If you submit reviews, testimonials, photos, questions, or other content to us through our website, email, or any platform where we are present, you grant ExecPro a non-exclusive, royalty-free, perpetual, and worldwide license to use, display, reproduce, and distribute that content in connection with our business, marketing, and website, unless you explicitly request otherwise.

You represent that you own or have the right to submit any content you provide to us, and that your submission does not infringe the rights of any third party.

12. Third-Party Services and Links

Our Site may link to or embed third-party services, including review widgets, scheduling tools, advertising platforms, or informational resources. ExecPro does not control these third-party services and is not responsible for their content, privacy practices, or availability. These Terms do not govern your use of third-party sites or services; please review their own terms and policies directly.

13. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to these Terms, the use of this Site, or the services provided by ExecPro that cannot be resolved through good-faith communication between the parties shall be submitted to binding arbitration in Mercer County, New Jersey, in accordance with the rules of the American Arbitration Association, unless both parties agree otherwise in writing.

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent irreparable harm pending the resolution of a dispute.

Nothing in these Terms limits any statutory rights you may have under New Jersey consumer protection laws, including the New Jersey Consumer Fraud Act (N.J.S.A. 56:8-1 et seq.) and the New Jersey Home Improvement Contractor Act (N.J.S.A. 56:8-136 et seq.).

14. Compliance with New Jersey Home Improvement Law

ExecPro operates in compliance with applicable New Jersey home improvement contractor requirements. Any home improvement contract with a value of $500 or more is subject to the requirements of the New Jersey Home Improvement Contractor Act. Under that law, you have certain rights, including the right to receive a written contract before work begins, the right to cancel within 72 hours of signing for certain types of contracts, and protections against unfair or deceptive practices.

If any provision of a specific home improvement contract conflicts with these general Terms, the terms of the signed written contract will govern for that project.

15. CAN-SPAM and TCPA Compliance

ExecPro complies with the CAN-SPAM Act and the Telephone Consumer Protection Act (TCPA). Every commercial email we send includes a valid return address, an honest subject line, our business identification, and a functioning opt-out link. We honor opt-out requests within 10 business days.

For phone and text outreach, we comply with applicable do-not-call regulations and maintain an internal do-not-call list. To be added to our suppression list, email hello@execprorc.com with "Opt Out" in the subject line, reply STOP to any text message, or call (888) 300-3772 and request removal. Suppression requests are processed promptly and are permanent until you affirmatively re-engage with us.

16. Force Majeure

ExecPro shall not be liable for any delay or failure to perform services resulting from circumstances beyond our reasonable control, including acts of God, natural disasters, extreme weather, public health emergencies, government orders, labor disputes, or supply chain disruptions. In such circumstances, we will notify you promptly and work to reschedule or otherwise accommodate your needs as soon as reasonably practicable.

17. Modifications to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page. Continued use of this Site or engagement of our services after any such update constitutes your acceptance of the revised Terms.

18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision will be modified to the minimum extent necessary to make it enforceable, or severed from these Terms if modification is not possible, without affecting the validity or enforceability of the remaining provisions.

19. Entire Agreement

These Terms, together with any applicable Service Agreement, Privacy Policy, and Disclaimer, constitute the entire agreement between you and ExecPro regarding your use of this Site and the services described herein. They supersede any prior or contemporaneous communications or understandings, whether written or oral, unless otherwise expressly agreed in writing by ExecPro.
